Privacy Policy

1. Scope

This protection and treatment policy shall apply to all personal data collected through the institutional website of Fundación de Waal (hereinafter FdW) and other IT platforms and/or physical channels. FdW collects and uses personal data of the people interested in taking part in its training processes.
FdW collaborators who handle and process personal data are obliged to sign confidentiality agreements in accordance with this policy.

2. Purpose of the personal data processing policy

To inform in detail to those who access the electronic channels of FdW how the information and personal data of the users of the services provided by this organization is treated.

3. Data collected

FdW, through inter-institutional agreements and through its PreNatal Program, collects information and personal data such as:

  • ID card number
  • Names and surnames
  • Date of birth
  • Geographic location data
  • Contact information
  • General education characteristics
  • Employment data
  • Demographic information, knowledge, attitudes and practices of participants through anonymous surveys.
  • Photographs and videos as a record of the processes carried out.

4. Purpose

FdW uses personal information for the following purposes:

  • Measurement of behavioral changes in the population receiving training workshops through anonymous KAP (Knowledge, Attitudes and Practices) surveys.
  • Registration of participants for your training programs.
  • Registration of course approval certificates with the institutions that endorse these processes.
  • Establish a line of communication with the participants and follow up on their work after the training received and offer new training opportunities.
  • Receive feedback from the participant on the information that is published.

5. Process for exercising the right of access and rectification

The holders of personal data are entitled to access and rectify their personal data. To make these update requests, you must perform the following actions:

  • Create a ticket using the “Type of Request”: Right of Access LOPDP or Right of Rectification LOPDP.
  • Complete all the fields of the form and finally press the “Submit” button.
  • FdW analyzes whether the request is admissible or not and notifies the owner by e-mail.

6. Notifications when there are changes in the privacy policy.

FdW may update its privacy policy from time to time. 7. Use of cookies

FdW may use the user’s personal data, including data collected as a result of site navigation and electronic logs and protocols to help create and customize website content, improve the quality of the website, track the responsiveness of the services delivered.

8. Measures to safeguard the security of personal data

The FdW uses the HTTPS protocol to provide security in the use of its electronic channels.
FdW carries out a process survey in order to standardize the activities performed in the processing of information; these processes are reviewed regularly to ensure that they comply with the standards and good practices adopted by the organization, within the framework of data quality and security.
FdW promotes formality, commitment and responsibility among its employees through the signing of confidentiality agreements, the formation of adequate data handling habits, and the adoption of good practices for the handling and use of data.

Terms and conditions of use

The use of the FdW web portal or any of its components implies the express acceptance of these terms and conditions of use.
FdW uses the web portals and systems to present information on the management it carries out.

1. Responsibility

FdW is responsible for the treatment and use of personal data collected through inter-institutional agreements or directly from its institutional website and other electronic and physical channels. FdW assumes no responsibility that may be generated by the user for any improper use or contrary to the purposes of this electronic channel.

2. Obligations of the user

  • Not to damage, disable, modify or deteriorate the electronic channels to which you are having access, nor the contents incorporated and stored in them.
  • Not to use modified versions of systems in order to obtain unauthorized access to any electronic channel, content and/or services offered through them.
  • Not to interfere with or disrupt the access, functionality and use of electronic channels and networks connected to it.
  • The use of this portal or any of its components implies the express acceptance of these terms and conditions of use.
  • The FdW has this web portal to provide information to the public on important issues and the management of the organization.
  • Data that have received statistical treatment can be made available in open formats to facilitate their use.
  • Procedures and services performed after eighteen hours or on non-business days will be considered to be performed on the following business day.

3. Applicable Legislation

This Personal Data Protection Policy is governed by the provisions of the current legislation on the protection of Personal Data referred to in Article 92 of the Constitution of the Republic of Ecuador, and other corresponding regulations.

4. Conservation time

FdW will keep the Personal Data for seven (7) years from your consent, without prejudice to your registration on the Website or other platforms.
After the time periods for the conservation of the information have expired, such information will be anonymized in FdW’s repositories and will be kept only for the purpose of studies and research that contribute to decision making.

5. Transfer, Transmission and Disclosure of Personal Data

FdW transfers the lists of participants and qualifications generated in its training processes to the entities that endorse such processes for the issuance of their certificates of approval.

6. Terms and definitions

Anonymization: The application of measures of any nature aimed at preventing the identification or re-identification of a natural person without disproportionate efforts.
Database: A set of data belonging to the same context and systematically stored for use.
Consent: Manifestation of free, prior, specific, express, informed and unequivocal will, by which the owner of the personal data authorizes the person responsible for the processing of personal data to process the same.
User: Natural or legal person, public or private, who accesses the services of the National System of Public Data Registry, pursuant to number 13 of the Seventh General Provision of the Regulations to the Organic Law of the National System of Public Data Registry.
Personal data: Data that identifies or makes identifiable a natural person, directly or indirectly, in the present or future. Harmless data, metadata or data fragments that identify or make identifiable a human being, are part of this concept.
Recordable personal data: Personal data that according to the legal system must be contained in Public Registries.
Sensitive data: Sensitive data are considered those related to: ethnicity, gender identity, cultural identity, religion, ideology, political affiliation, judicial history, migratory status, sexual orientation, health, biometric data. genetic data and those whose improper processing may give rise to discrimination, infringe or may infringe human rights or the dignity and integrity of persons. The National Public Data Registry Directorate may determine other categories of sensitive data.
Processor of personal data: Natural or legal person, public or private, who processes personal data on behalf of and for the account of a controller of personal data.
Data subject: Natural person whose data is the object of processing.
Processing: Any operation or set of operations performed on data, whether by automated, partially automated or non-automated technical procedures, such as: collection, compilation, obtaining, recording, organization, structuring, transformation, conservation, custody, adaptation, modification, elimination, indexing, extraction, consultation, elaboration, use, possession, exploitation, communication by transmission, transfer, dissemination, processing, storage, distribution, assignment, or any other form of enabling access, interconnection, limitation, suppression, destruction and, in general, any use of personal data.
